Local 106 Fighting for you in the Courts!
Last week our attorneys filed a motion with the New York State Supreme Court asking the judge in our lawsuit against the Department of Finance and the New York City Transit Authority to issue a default judgment against the Department of Finance. The Department of Finance in conjunction with the NYC Transit Authority have been disgracefully ticketing our transit vehicles while we are operating in the performance of our duties in bus lanes, bus stops and busways. To make matters worse those fines escalate each time that vehicle is ticketed. We have taken aggressive action in the courts and elsewhere to protect our members from this ruthless and thoughtless money grab, against the only city workers that should have been exempt from day one, the New York City Transit Worker!
Snippet from the motion;
“10. As of the date of the filing of this motion, one hundred nineteen (119) days has passed without an appearance of counsel, a responsive pleading or motion being filed by the New York City Department of Finance. 11. In addition to the New York City Department of Finance’s failure to respond within the statutory time frame, its failure to serve a timely answer or appear, the Petitioners/Plaintiffs claim concerning the misapplication by the Respondents/Defendants of §1111(c) V&T Law is meritorious as set forth in Plaintiffs/Petitioners’ responsive pleadings filed with the Court”.
We will continue to fight the Department of Finance and the New York City Transit Authority until we get this injustice rectified.
